    The E visa, or Treaty Investor Visa, is a temporary nonimmigrant work visa in the U.S. for people from certain countries that have a special trade agreement with the U.S. who do the following:
    1. Invest a significant amount of money in a U.S. business or entity (E investor)
    2. Come to work in the U.S. as an executive, manager, or essential employee of a company owned by someone from their country (E employee)

    E-1 Visa Eligibility Requirements

    1. Trade: The enterprise must be engaged principally and substantially in trade between the U.S. and the treaty country (of goods, services, technology, tourism, or other intangible items with intrinsic value).

    2. Investor/Employee with Executive or Managerial capacity or Specialized Qualifications: The foreign national is the actual owner of a qualifying enterprise or an employee of such enterprise working in an executive or supervisory capacity or in a capacity which requires special qualifications essential to the operation of the enterprise.

    3. Nationality: The principal employer must be either a person in the U.S. having the nationality of the treaty country (or, if not in the U.S., otherwise entitled to treaty trader status) or an enterprise at least 50% owned by persons in the U.S. of such nationality. The foreign national must have the same nationality as the principal employer.

    E-2 Visa Eligibility Requirements

    1. Nationality: The investor, or investment entity, is a citizen of a country with a treaty of commerce and navigation with the U.S.
    2. Investment: of a significant amount of money into a real business in the U.S.
    3. Active Management: of the U.S. business by the investor.
    4. Legitimacy of Enterprise: The business is a real, bona fide legal venture, showing potential for growth and job creation in the U.S. with the capacity to generate more than a marginal income.
    5. Source of Funds: The funds invested in the U.S. business have a legitimate source.

    E-3 Visa Eligibility Requirements

    The E-3 visa classification applies only to nationals of Australia who are coming to the U.S. to perform services in a specialty occupation.

    1. The specialty occupation requires theoretical and practical application of a body of highly specialized knowledge and the attainment of a bachelor’s or higher degree in the specific specialty, or its equivalent, as a minimum for entry into the occupation in the United States.
    • Are a national of Australian nationality.
    • Legitimate offer of employment in the U.S. 
      • If filing from within the U.S., a filed Labor Condition Application (LCA) for E-3.
    • Possess the required academic (or equivalent) or other qualifying credentials for the specialty occupation.
    • Will fill a position that qualifies as a specialty occupation

    There may be additional or special provisions beyond the information listed above.
