    The EB-1A is an employment-based first preference visa category in the U.S. for immigrants who have extraordinary ability in the fields of business, athletics, arts, science, or education.

    EB-1A Extraordinary Ability Criteria:

    2. Memberships: Documentation of membership in associations requiring outstanding achievements as judged by recognized experts;

    3. Publications: Published material in professional or major trade publications or other major media about the applicant relating to work in the field;

    4. Judging: Participation as a judge of the work of others;

    5. Original Contribution of Major Significance

    6. Authorship: Authorship of scholarly articles in the field, in professional or major trade publications or other major media;

    7. Exhibitions or Showcases: Display of work in the field at artistic exhibitions or showcases;

    8. Roles: Performance in a leading or critical role for distinguished organizations or establishments;

    9. Salary: Command of a comparatively high salary or other remuneration for services;

    10. Commercial success in the performing arts.

    Comparable Evidence of the above may be included.

    EB-1B or EB-1OR Extraordinary Ability Criteria (Outstanding Professor or Researcher)

    Evidence that the professor or researcher is recognized internationally as outstanding in the academic field shall consist of at least two of the following:
     
    • Evidence of receipt of major prizes or awards for outstanding achievement.
    • Evidence of membership in associations that require their members to demonstrate outstanding achievement.
    • Evidence of published material in professional publications written by others about the noncitizen’s work in the academic field.
    • Evidence of participation, either on a panel or individually, as a judge of the work of others in the same or allied academic field.
    • Evidence of original scientific or scholarly research contributions in the field
    • Evidence of authorship of scholarly books or articles in the field.
    Additional Requirements:
    • Requires Employer Sponsorship by a U.S. Employer.
    • The petitioning U.S. employer must be able to demonstrate a continuing ability to pay the offered wage as of the priority date.
    • Evidence of a job offer from a qualifying prospective employer of tenured or tenure-track employment  or permanent employment in a comparable research position.
    • Evidence that the beneficiary has had at least 3 years of experience in teaching or research in the academic field.
    • Evidence to demonstrate that the beneficiary is recognized internationally as outstanding in the academic field specified in the petition.
    • Requires a totality of the evidence determination to determine whether the beneficiary is outstanding. 
    Special Provisions
    • A labor certification is not required.

    EB-1C Extraordinary Ability Criteria (Multinational Manager or Executive)

    A petition for a multinational executive or manager requires sponsorship by a U.S. employer and must be accompanied by a statement from an authorized official of the petitioning United States employer which demonstrates that:
     
    The petitioning U.S. employer:
    • Must have been doing business in the U.S. for at least 1 year prior to filing.
    • Must demonstrate that the beneficiary has been employed for at least 1 year by a related organization abroad to work in a capacity that is managerial or executive.
    • Must demonstrate that it and the related organization abroad:
      • Maintain a qualifying relationship; and
      • Are both actively engaged in doing business.
    •  Must show that the beneficiary’s foreign employer and the proposed U.S. employer are the same employer or related as a parent and subsidiary or as affiliates.  
    • Must be able to demonstrate a continuing ability to pay the offered wage as of the priority date.
    The beneficiary:
    • If outside the U.S., within the 3 years immediately prior to filing the petition, the beneficiary has been employed outside the U.S. for at least 1 year in a managerial or executive capacity by a firm or corporation, or other legal entity, or by an affiliate or subsidiary of such a firm or corporation or other legal entity; or
    • If in the U.S. working for the same employer or a subsidiary or affiliate of the firm or corporation, or other legal entity by which the beneficiary was employed overseas, in the 3 years preceding entry, the beneficiary has been employed by the entity abroad for at least 1 year in a managerial or executive capacity
    Special Provisions
    • A labor certification is not required.
